1. Introduction
Wixsy (Pty) Ltd ("Wixsy", "we", "us") is committed to protecting your personal information in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA"). This policy explains what information we collect, how we use it, and your rights.
2. Information we collect
We collect information you provide directly to us: contact details (name, WhatsApp number), business information (business location and type), and any enquiry content submitted via our contact form. We do not collect sensitive personal information as defined by POPIA.
3. How we use your information
We use your information only for the purpose for which it was provided: responding to your enquiry, following up on your interest in Wixsy services, and communicating about a business relationship. We will not use your information for marketing without explicit consent, and will not sell, share, or transfer your information to third parties without consent.
4. Lawful basis for processing
We process your personal information on the basis of your explicit consent, given when you submit our contact form. You may withdraw consent at any time by emailing hello@wixsy.co.za.
5. Data retention
We retain your personal information for no longer than 12 months from the date of last contact, unless you have entered into a business agreement with us. You may request deletion of your information at any time.
6. Data storage and security
Your data is stored on servers located in South Africa (AWS Cape Town region). We implement industry-standard technical and organisational measures to protect your personal information against unauthorised access, disclosure, or destruction.
7. Your rights under POPIA
You have the right to: access the personal information we hold about you; request correction of inaccurate information; request deletion of your personal information; object to the processing of your personal information; and lodge a complaint with the Information Regulator (South Africa). 8. Order Liability & Customer Conduct
Wixsy provides the technology that receives, processes, and confirms orders on behalf of the business. Wixsy is not responsible for the conduct of end customers. This includes, but is not limited to: orders placed by customers who fail to collect or pay, fraudulent or bogus orders, abusive or spam messages, or any dispute between the business and its customers regarding an order. The business remains solely responsible for fulfilling, refunding, or cancelling orders, and for any commercial relationship with its own customers. Commission, where applicable, is charged only on orders successfully processed and paid through the Wixsy platform.
