1. About these terms
Wixsy (Pty) Ltd ("Wixsy", "we", "us") provides an AI-powered WhatsApp ordering platform for restaurants and businesses. These terms govern your use of the Wixsy service. A detailed Service Agreement is provided to, and signed by, each client on sign-up.
2. The service
Wixsy is an AI WhatsApp ordering assistant. The service includes menu management, order capture, kitchen notifications, customer order confirmations, and optional PayFast payment integration.
3. Client responsibilities
As a client you are responsible for maintaining a dedicated WhatsApp number for your business, keeping your menu information accurate, and operating a lawful business. You remain solely responsible for your own products, food safety, pricing, and customer service.
4. Fees & billing
Wixsy charges a monthly subscription plus an optional per-order commission depending on your plan, and a once-off setup fee applies. Full fees are confirmed in your signed Service Agreement. Detailed cancellation and refund terms are set out in our Refund & Cancellation Policy.
5. Payments
Where online payment is enabled, payments are processed by PayFast. Each client maintains their own PayFast merchant account, and order funds settle directly to that account.
6. Data & privacy
Wixsy processes end-customer data as an operator under POPIA on behalf of the client. For details of how we handle personal information, see our Privacy Policy.
7. Intellectual property
The Wixsy platform, software, and underlying technology remain the property of Wixsy. Clients receive a licence to use the platform for the duration of their subscription.
8. Service availability
Wixsy targets high availability, but the service relies on third-party platforms including Meta WhatsApp, AWS, and PayFast. We do not guarantee uninterrupted or error-free service.
9. Limitation of liability
Wixsy’s liability is limited as set out in the signed Service Agreement between Wixsy and the client.
10. Governing law
These terms are governed by the laws of the Republic of South Africa.
A full Service Agreement containing the complete terms is provided to each client before onboarding. These website terms are a summary and do not replace that agreement.
